Sacramento judge orders release of alleged rape victim/witness

A 17-year-old alleged rape victim who has been held on a material witness warrant since March 23 was ordered released today by a Sacramento judge.

Superior Court Judge Lawrence G. Brown again apologized to the girl who sat and smiled at the attorneys' table today in contrast to the tears she sobbed in her last court appearance a week ago Friday.

Brown ordered that the girl be equipped with a global position system device to ensure that she appears at the scheduled April 23 trial for accused rapist Frank William Rackley Sr., 37.

The judge told her she has showed "great courage" through the ordeal and asked that "you continue to do so for the trial of Mr. Rackley."

Brown ordered the girl jailed last month after she failed to make two court appearances, one for Rackley's preliminary hearing and another for his trial.

The Sacramento County District Attorney's Office sought the material witness warrant after they were forced to dismiss charges on Rackley on Feb. 28. They have since been refiled.
