A Sacramento Superior Court jury today acquitted one reputed street gang member and failed to reach a verdict on a second in a retrial into an Oct. 12, 2008, shooting at a 65th Street mini-mart in which two rivals were injured.
Xavier Jeremiah Whitfield, 21, was found innocent of attempted murder charges by the panel in the so-called "Killa Mobb II" case in which two other men already have been convicted. But Whitfield was found guilty in another gang beating trial last year and is awaiting sentencing. Whitfield also is awaiting trial in a jail assault case. He was represented at trial by attorney Jon Lippsmeyer.
Jurors split 6-6 in the retrial of co-defendant Antonio Terrell Cornelius, also 21, and Judge Cheryl Chun Meegan declared a mistrial on his matter. Deputy District Attorney Jeff Hightower did not say whether his office intends to put Cornelius on trial a third time. Attorney Pete Kmeto represented Cornelius.
