The California 3rd District Court of Appeal today denied a petition filed on behalf of a Sacramento juror who fought a judge's order to make available his Facebook postings written while he was sitting on a jury on a gang beating case.
The attorney for the juror could not be reached immediately, but the lawyer, Kenneth L. Rosenfeld, had previously said he would take the appellate court's decision to the California Supreme Court if it went against him.
Sentencing on the defendants who were convicted in the gang trial has been delayed for nearly two years pending higher court rulings. Sacramento Superior Court Judge Michael P. Kenny last year ordered the juror to make his postings available to defense attorneys. They wanted to review the writings out of concern that the juror either was biased or had been influenced by his friends on the social networking site.
