Judge says juror has 'consented' to Facebook postings release

The Sacramento juror who posted his thoughts on Facebook about a gang beating trial he sat on two years ago moved closer today to turning over his writings to a judge who ordered him in February 2011 to make them available.

Sacramento Superior Court Judge Michael P. Kenny, following a meeting in his chambers with attorneys for the lawyer, Facebook and five defendants who want a new trial, said the juror has "consented" to the turnover.

Kenny said from the bench he will give the juror two weeks "to provide a specific dump of all information" he wrote and received on his Facebook page during the 2010 trial. The juror has fought the order for 17 months but has failed to have it overturned in various appellate courts.

The judge scheduled another hearing on the juror's Facebook postings for Oct. 1. The five defendants are scheduled to be sentenced on Nov. 2.
