Accused Old Sacramento gunman Carlito Montoya is scheduled to appear with his two alleged accomplices in Sacramento Superior Court on Tuesday; but it does not appear he will be able to speak at the hearing.
Montoya, 22, has his jaw wired shut, a security guard at the Sacramento County Main Jail told The Bee today after a reporter requested an interview. Montoya is being housed on the jail's medical floor because of injuries he suffered in the deadly New Year's Eve melee.
Sacramento police allege Montoya fatally shot two men and injured two people after a fight broke out at the Sports Corner Cafe that night. After quickly being detained by officers, Montoya was treated at a local hospital for multiple gunshot wounds he received when a security guard intervened, police say. He was booked into the jail late Friday night.
Amber Scholz, 36, is accused of instigating the argument that turned physical and then escalated into the shooting. Her husband, Charles Fowler-Scholz, 34, is accused of being a part of that fight.
Scholz and her husband are being held in lieu of $1 million bail each and are expected to be arraigned Tuesday afternoon on charges of assault with a deadly weapon. Montoya, who is being held without bail, is expected to be arraigned on charges of murder, attempted murder and assault with a deadly weapon.
Killed in the shooting were Gabriel Cordova, 35, and Daniel Ferrier, 36, a bar employee who tried to intervene. Injured were Cordova's wife, Christina, 30, and the security guard, Stephen Walton, 46.
