Alleged rape victim likely to testify at former cop's hearing

Baker,+Gary-49.jpgA judge Tuesday scheduled a special hearing for the alleged victim to testify in the alleged rape case filed against a former Sacramento police officer.

The 78-year-old woman identified only as "Jane Doe" will testify against the former officer, Gary Dale Baker, 49, in a "conditional examination" that Sacramento Superior Court Judge Laurel D. White set for March 6.

Deputy District Attorney Amy Holliday said in her motion for the conditional examination that the alleged victim "suffered a severe stroke which limited her ability to communicate."

Under state law, attorneys can request conditional examinations if witnesses are about to leave the state, if they are so "sick or infirm" that they may not be able to attend trial, if they are 65 or older or if their lives are in jeopardy.
