Former Twin Rivers police officer pleads no contest to assault

A former Twin Rivers Police Department officer has pleaded no contest to misdemeanor assault under the color of authority.

On Sept. 17, 2010, Branche Smith, 38, grabbed two individuals by the neck in choke holds and lifted them off benches to which they had been secured by handcuffs, according to a Sacramento County District Attorney's Office news release. He also pointed his Taser at the chest of a third individual handcuffed to a bench and threatened to deploy the device if that individual did not stop shaking, authorities said.

On May 30, 2011, Smith kicked a handcuffed individual in the head while that subject was restrained at the jail.

The District Attorney's Office announced that Smith was sentenced to three years of probation and ordered to serve 60 days in the county jail. He can apply to the Sheriff's Department for a work-release program.
