Jury fails to reach verdict on defendant's second murder count.

The same Sacramento County jury that convicted Luis Prudente on one count of murder has failed to reach a verdict on a second killing, and Judge Marjorie Koller on Tuesday declared a mistrial.

Sacramento prosecutors have not decided yet whether to retry Prudente, 20, who was accused of murder in the fatal Oct. 23, 2009, hit-and-run on El Camino Avenue that left Julian Juan Dearcos, 35, dead, according to Deputy District Attorney Michael Kane.

Koller set Prudente's next court date for Aug. 12. He faces a scheduled Aug. 27 sentencing for his first-degree murder conviction in the Nov. 27, 2010, shooting death of Jesse Dean Jones, 15. Authorities said the Jones killing was gang-related.
