Downtown Sacramento shooter was Mendocino deputy DA, his boss says

Authorities say that it was a Mendocino County Deputy District Attorney who shot and wounded another man on a downtown Sacramento street early Thursday morning.

Mendocino County District Attorney David Eyster confirmed in a press release that one of his deputy district attorneys, Damon Gardner, shot and wounded another man during a "physical confrontation" outside a hotel near the Capitol.

Sacramento police said that officers were initially summoned at about 12:30 a.m. Thursday to a report of a knifing near 15th and L streets. When officers arrived, they learned that a man had actually been shot in his upper body.

A Sacramento police activity report said that two people passed two others when an argument began between the two groups. Words escalated into a fight and then a shot was fired.

The wounded man was transported to the hospital for a non life-threatening injury.

The deputy district attorney, Gardner, has been on medical leave from the Mendocino district attorney's office since mid-August.

The Mendocino district attorney said that another of his deputy district attorneys witnessed the shooting. The prosecutor who witnessed the shooting was in Sacramento to attend a legal education seminar.

Late Thursday night, the Sacramento Police Department said in a press release that there had been no major developments in the case and detectives continue to investigate. Police investigators will work with the Sacramento County District Attorney's Office to determine if charges are filed.
