Ex-Sacramento police officer faces trial in alleged sexual attacks

A former Sacramento police officer was ordered today to stand trial for rape and other charges in three alleged sexual attacks on a stroke-impaired woman in her 70s.

Gary Dale Baker will be arraigned Oct. 17 as a result of the holding order issued by Sacramento Superior Court Judge Patrick Marlette following a preliminary hearing that took eight court days.

Baker, 50, who is free on $1 million bail, is charged on two counts of rape, two counts of forced oral sex, two counts of sexual battery and one count of attempted sexual assault during a first-degree burglary. He will also stand trial on other counts of sexual assault during the commission of a first-degree burglary. The burglary-related offenses could bring Baker a life term if he is convicted on them.

The judge did not hold Baker to answer on charges that he had sexual intercourse with a person who was unable to give consent.

Baker allegedly admitted to having consensual sex with the woman, according to one detective's testimony.

According to police and prosecutors, the alleged offenses took place Nov. 24, 2010, Sept. 20, 2012, and Dec. 11, 2012.

Marlette also ruled as admissible some of the hearsay accounts of the woman's communications with police investigators and to family members concerning her interactions with Baker.

The alleged victim was 75 and 77 years old at time of the interactions, according to the prosecution. She suffered a stroke in 2009 that left her with speech aphasia, a condition that severely restricts her ability to speak and write.
