The trial for one defendant in a Sacramento murder case will have to start over after Superior Court Judge Russell L. Hom found the prosecutor violated evidence rules by withholding information from a jailhouse informant.
Hom declared a mistrial in the state's case against Bryan David Denton, 51, after the defendant's attorney argued that the information might have altered the defense's courtroom strategy.
But the judge rejected a similar request by co-defendant Stacey Ann Perryman, 45, and her case will proceed.
Denton and Perryman are accused of the May 19, 2012 stabbing death of Stephen Sieck, 60, at his Selby Ranch apartment. Deputy District Attorney Eric Kindall told the court he withheld the statement because it would place an informant in danger.
