Citing "the unique circumstances" of transition to a new administration, attorneys representing Gov. Jerry Brown and Attorney General Kamala Harris have asked an appellate court to push back deadlines for submitting briefs in what has been a running feud over furloughs between the executive branch and other statewide-elected officials.
The request asks the 3rd District Court of Appeal in Sacramento to add at least 30 days to the Jan. 26 date that the first documents are due. The court had said on Jan. 11 that it wouldn't grant any extensions.
Deputy Attorney General Mark Beckington, representing Harris and the other constitutional officers, and attorney Kristianne Seargeant -- on behalf of administration lawyer David Tyra -- both signed the request:
In light of the numerous issues that Governor Brown and the incoming administration are addressing in making the transition into office, the Governor requests additional time to analyze the case. The constitutional officers, appellants herein, do not oppose the request for additional time, and therefore join the request to continue the supplemental briefing schedule.
The lawyers noted that San Francisco's 1st District Court granted a similar request in another furlough matter, SEIU Local 1000 v. Schwarzenegger. Oral arguments scheduled in that case for Jan. 12 have been pushed back to Feb. 16. (Click here to see the SEIU court docket.)
